EC ADVANCES IMPLEMENTATION OF EFTI REGULATION WITH NEW DELEGATED ACTS

On July 15th and 26th, 2024, the European Commission made progress in the implementation of Regulation (EU) 2020/1056 on electronic freight transport information (eFTI) by adopting two delegated acts. These acts are essential to enhancing the regulatory framework governing electronic information exchange in freight transport across the European Union, facilitating smoother compliance processes for economic operators and ensuring better coordination with national authorities.

The first delegated act, adopted on July 15th, introduces amendments to Part B of Annex I of the eFTI Regulation. This amendment incorporates references to regulatory information requirements as established in the national laws of EU Member States, based on notifications received under Article 2(2) of the eFTI Regulation. By doing so, the amendment ensures that economic operators can provide electronic information to demonstrate their compliance with both national and EU-level legal requirements.

In recognition of the ongoing nature of these notifications, the European Commission has set up a regular cycle for adopting these updates. Moving forward, updates will be adopted twice a year, by July 31st and December 31st, depending on the timing of notifications from Member States. This structured approach ensures that the regulatory framework remains current and aligned with national requirements, facilitating smoother operations for businesses across the EU.

On July 26th, the European Commission adopted the second delegated act, which establishes the eFTI common data set and eFTI data subsets. These standardised data sets are designed to enable the secure recording and exchange of information between the eFTI platforms used by economic operators and the IT systems of competent authorities. By aligning these data sets with existing models, such as the Union Customs Code data model and the European Maritime Single Window environment, the Commission aims to ensure interoperability and efficiency in the exchange of information.

The establishment of these common data sets and subsets is a crucial step in reducing the administrative burden on operators while enhancing the quality and consistency of information available to authorities. This measure not only simplifies the process of regulatory compliance but also supports the broader goal of creating a more integrated and efficient freight transport system across the European Union.
